Lawyers ! Want Reforms ? Prosecute Judge Zainon binti Mohd. Ali for Aiding & Abetting

I read on your Malaysian Bar Council website that on the 22, Nov., 2007 your Members will be holding a general meeting to ask the Government for radical reforms to ensure the independence and integrity of the Malaysian judiciary. I vaguely understand that this agitation arose out of the shady elevation and appointment of one of your senior judges to the Court of Appeal Bench, without the usual consultation and recommendations of the Malaysian Bar Council. I have to admit that my understanding of the issues is very sketchy. I was in KL when this dispute appeared in the newspapers. If this involved the retired Chief Judge of Malaysia, then why flog a pensioned off and retired Judge; when you can have a “LIVE” senior Judge of the Court of Appeal to UNDERPIN YOUR AGITATION FOR MEANINGFUL REFORMS ?

My wife’s case is copiously published in my blog @http://yapchongyee.blogspot.com I have to comment that Malaysia is not a modern state. It is still 3rd World and 3rd rate, UNLIKE SINGAPORE which stands out as the beacon and standing example of a developed and modern state. WHAT CAN YOU SAY FOR A MALAYSIA WHICH IS THE LAUGHING STOCK OF THE MODERN WORLD, WHEN IT IS KNOWN TO ALL THE WORLD THAT SHARIAH LAW TRUMPS THE MALAYSIAN CONSTITUTION ? There is no other nation state that such an illiterate joke stands out a judicial precedent in all of the Anglo-American-Australian, Singapore, New Zealand, India, Pakistan and all of the countries where the English Common Law is the law of the land. I have to be thinking “why do you Malaysians not make the Shariah Law, the CONSTITUTION OF MALAYSIA ? That why at least the rest of the world can understand better why Shariah Law can so easily trump your prevailing “MALAYSIAN CONSTITUTION ?”

There was a time, a very longtime ago, when even Malay Judges lived by their oath of office, that they will faithfully uphold the integrity and principles of the law of Malaysia. It is regrettable that Malay Judges today take upon themselves to deal with the cases before them with the absolute arrogance of illiteracy & blissful ignorance; more often, it is a case of imposing their own whim, willy nilly. There is no law in Malaysia because today in Malaysia you cannot have the certainty of “poking your finger and say this is the law and I am entitled to this or that RELIEF IN LAW. You just cannot say that anymore and a glaring example is my wife’s case in point. That is exactly what Judge Zainon binti Mohd. Ali did. Her Judgment (for 9 years and more, my wife’s case had been unlawfully struck out and Judge Zainon biinti Mohd. Ali does not have the adequate literacy and knowledge of the law to DELIVER HER JUDGMENT. 9 years composed of 6 years to consider respondents’ interlocutory application for security for costs and the other three for her order for striking out. The fact that Judge Zainon binti Mohd. Ali and the respondents had ENFORCED HER AWARD OF RM.60,000 AS SECURITY FOR COSTS, and then HAVING ENFORCED HER ORDER FOR SECURITY FOR COSTS, AND GONE ON AT A LATER TIME TO AWARD TO RESPONDENTS HER ORDER TO STRIKE OUT PETITION MAKES HER AN ACCOMPLICE TO OBTAIN MONEY UNDER FALSE PRETANCES. Her refusal to give leave to petitioner to cross examine the said 3 criminals for Perjury and forgery, when she had before as exhibits our 3 police reports charging the said 3 criminals for the said criminal offences makes her actions AIDING & ABETTING the said criminals in their criminal behaviour.

What can I say, the ignorance & illiteracy of Judge Zainon binti Mohd. Ali through her ignorance of the law performed her duty in a manner that caused her to commit several criminal offences. Is this not what you, members of the Malaysian Bar are meeting this 22 November, 2007 to agitate for reforms ? Why bother a retired Judge ? Why not point your finger at my wife’s petition and say what shit system is in place in Malaysia for the appointment of judges to the High Court.

By the way, your demonstration at the PALACE OF JUSTICE was reported in the Chinadaily newspaper in Beijing. I will post the report soon as I get my scanner in place. A bit lazy lah !
